These General Terms and Conditions of the Autokaubad24 OÜ (hereinafter referred to as the Seller) e-shop's terms and conditions (hereinafter referred to as the Terms) apply to all persons (hereinafter referred to as the Buyer or Recipient or Consumer ) who use the www.ak24parts.com e-shop (hereinafter referred to as the e-shop), order goods and services (hereinafter referred to as the Goods) from the e-shop, including by concluding a purchase and sale agreement (hereinafter referred to as the Sales Agreement) to purchase goods from the e-shop.

By making a purchase, the Buyer confirms that he/she has read the terms and conditions of the Sales Agreement, agrees with them and complies with them.

1. BUYING / ORDERING GOODS

1.1 All spare parts are sold at a discount of -15%
1.2 Buyer doesn't need to register as a user to make a purchase from the ak24parts.com e-shop. It is enough to fill out the form with the simple necessary data to make purchase. However, as a registered user, you have advantages: the ability to save favourite products  and, if desired, to complete the purchase process later, you can subscribe to your email notifications about special offers and campaigns. Track your orders. 

• 1.3 ak24parts.com IS NOT RESPONSIBLE FOR THE SUITABILITY OF THE SPARE PART FOR YOUR CAR. WHEN ORDERING SPARE PARTS, PLEASE MAKE SURE BEFORE MAKING THE PURCHASE THAT THE SPARE PART FITS YOUR CAR FOR CERTAINLY! IF NECESSARY, CONSULT A MECHANIC WHO WILL BEGIN TO CHANGE THE SPARE PART.

• 2. DELIVERY TIME

• 2.1.1 The delivery time is indicated on each product separately. In general, the delivery time is:

3. GOODS WITH DEPOSIT MONEY - CORES

3.1 GOODS WITH DEPOSIT MONEY - CORE are considered to be starters, generators, steering racks, drive shafts, brake supports, power steering pumps, air mass meters, injection nozzles, etc. and in their case, the cost of the deposit is added to the price (it can vary from 10€ / 11.30$ ). The cost of the deposit depends on the specific product. The deposit is displayed next to the product in the shopping cart. The buyer will deliver the housing (old detail housing) with the deposit to car goods within 24 hours and no later than 6 months after receiving the order. Ak24parts.com will deliver the old body to the factory for inspection with a deposit. The deposit will be returned to the buyer after the factory has confirmed that the old housing meets the requirements stated in point 3.2. If ak24parts.com does not deliver the buyer's old housing or the housing returned by the buyer does not meet the requirements stated in point 3.2, the deposit is not subject to return to the buyer. It may take up to 3 months for the case to be inspected at the factory. Buying a product with a deposit is similar to buying a water bottle or other beverage bottle in a store. By bringing a bottle to the tare, you will get back the deposit amount. 

Example: 
You order a brake caliper.
Purchase price: 50€ / 57$
. The deposit for the housing is added to the purchase price (the amount varies depending on the product). 20€ / 23$
Total to be paid: 70€ / 79$
You receive the goods and change the brake caliper. You send or bring back the old brake caliper and you will be refunded the housing deposit of 20€ / 23$
In total, you paid 50€ / 57$ for the brake caliper

3.2 REQUIREMENTS FOR RETURNABLE STARTERS, GENERATORS, STEERING BARS, DRIVE SHAFTS, BRAKE SUPPORTS AND POWER STEERING PUMPS, AIR MASS READERS (GOODS WITH DEPOSIT MONEY ):

• • The old case must be returned clean in the same packaging you received purchased product! The packaging must not be damaged, and no tape must be applied to the packaging! The packaging must be wrapped properly with film and only then can you apply tape to the wrapped packaging.The case to be returned must be complete and able to be restored.
• • The case must not be mechanically damaged, welded, all fasteners and edges must be intact.
• • The mounting bolt holes must not be worn to an oval shape. The rotor shaft end of the starter must not be heated (blue), the shaft bushings must be intact. The technical data of the case to be returned must be at least equivalent to the one purchased.
• • The steering rack must not be oxidized, rusted, or damaged.

4. OTHER INFORMATION
 

• 4.1 Product images and screenshots are illustrative. Products may differ from the image shown. 
• 4.2 The price and/or availability of goods in the e-store may change continuously and without prior notice.
• 4.3 Ak24parts.com has the right to withdraw from the sales contract concluded through the e-store without sanctions and not deliver the ordered goods if the goods are out of stock, if the price or characteristics of the goods are not displayed correctly due to a system error or if the buyer does not meet the conditions for receiving the service. If the e-shop is unable to fulfill the order, the buyer will be contacted and the amount paid will be returned.
• 4.4 In the case of spare parts, to find out the correct price of the product, the product must be added to the shopping cart, after which the system will check the price in the importer's warehouse in real time, then the correct price of the product will be displayed in the shopping cart.
• 4.5 If the Buyer has chosen "I will pick it up" as the method of transport for the order, ak24parts.com has the right to demand from the Buyer a storage fee for the ordered goods in ak24parts.com warehouse (1€ per day) for a period exceeding two weeks, starting from the date on which the Buyer has been informed for him to come pick up the goods. Notification can be made by phone or e-mail.  
• 4.6 If the Buyer has not picked up the ordered goods within 3 months, the goods will be disposed of or destroyed.
• 4.7 If the Buyer has chosen "Courier service", "parcel locker" or another option as the delivery method and the courier has not been able to contact the Buyer to hand over the order due to circumstances caused by the Buyer, or the Buyer has entered incorrect data for handing over the goods to the Seller, the order will be returned to the Seller . The seller contacts the buyer to agree on the further delivery of the order. At the same time, the seller has the right until a new delivery has been agreed, to demand from the buyer a fee for storing the ordered goods in the warehouse of ak24parts.com (1€ / 1.13$ per day). If the Buyer does not agree on a new delivery of the order or does not pay the delivery fee within 3 months, the ordered goods will be disposed of or destroyed. 
• 4.8 The is no fee for changing or canceling the installment agreement.
• 4.9 Car spare parts, including car batteries (hereafter parts) must be ordered through the following car brand-based search: https://www.ak24parts.com/en/spareparts  The car models for which this part is suitable are indicated next to the part found by brand-based search. ak24parts.com cannot guarantee the suitability of the parts for the car on which the part is intended to be installed. If the parts are installed on a car that is not suitable, the parts will lose the warranty.
• 4.10 These terms and conditions and warranty terms apply only to private individuals. Legal entities must conclude a sales contract in which the conditions of purchase and sale and the guarantee are agreed upon.
• 4.11 All information related to the order on the part of the buyer must be forwarded by the buyer to the seller from the e-mail address specified by the buyer in the order.  
• 4.12.1 All prices of products displayed to customers in the European Union include VAT according to the country where the goods are ordered.
• 4.12.2 All prices of products displayed to customers outside the European Union do not include VAT and do not include other taxes that apply in the country where the goods are ordered.

5. RETURN OF GOODS
 

• 5.1 The consumer has the right to return the goods to Seller and get a refund of the product price within 14 days from the day of delivery. ak24parts.com will return product price received from the consumer on the basis of the contract to the consumer without delay, but no later than after 14 days. The Buyer has the right to receive a refund of the original shipping cost  only if the returned product has been declared defective during the warranty procedure or if ak24parts.com has sent the Buyer a product that the Buyer did not order (the code and description of the product received by the Buyer do not match the code and description of the product ordered by the Buyer). Buyers are required to send the product back to the Seller at their own cost. 
• 5.2 Purchased goods cannot be returned if the ordered goods have been made considering the personal needs of the consumer or according to the conditions provided by the consumer. The returned item must not be used and must be in the original packaging. The original packaging and the goods must not be damaged, must be in the same condition as when the seller sent them. If the product was purchased as part of a campaign, where another product is added to the product, the buyer must return the entire set. If a product/spare part set has been purchased, it can only be returned as a whole set, not its parts separately.
• 5.3 In order to return the goods, an application must be sent to [email protected] The application must contain the following information: the name and details of the buyer, the name and ID code of the goods to be returned, the number of the order and purchase invoice. The amount paid for the goods will be returned to the current account of the buyer (the person from whose account the money was transferred for the order) immediately, but no later than within 14 days from the return of the goods. It is not allowed to submit third party accounts for refunds.
• The costs associated with returning the product (including postage) are paid by the buyer. The goods can be returned   with a courier service or via a Smartpost or Omniva parcel machine.  Be sure to write the order/invoice number on the package.

• 5.4 In the case of goods that do not comply with the terms of the contract, that do not correspond to the offered sample or have defects, the buyer has the right to file a complaint and return the goods. The complaint must be submitted immediately, but no later than within two months from the discovery of the defect in the goods. The buyer must keep the purchase documents (invoice, contract, etc.) proving that the goods were purchased from the ak24parts.com e-store.
• 5.5 Ak24parts.com is not responsible for product defects that have arisen due to improper use, maintenance or damage of the product. If the goods are subject to more favorable warranty conditions (sales guarantee) than those stipulated in the law, then these conditions are given in writing together with the respective goods.
• 5.6 On the basis of § 562 subsection 4 of the Tax Code, the consumer is only responsible for the decrease in the value of the goods, which is due to the use of the goods in a way other than what is necessary to make sure of the nature, characteristics and functioning of the goods.
• 5.7 Ownership of returned products will only be transferred to the seller once the products have arrived at the Sellers return address.

6. PAYMENT
 

• 6.1 Stripe or Paysera with a bank link. You can pay the amount immediately using the bank link. If you wish, you can also save invoice 6.2 on your computer and pay later by bank transfer. 
• 6.2 By bank transfer - You will see bank account details in PDF format invoice.  If the money has not been received within a week after placing the order, the order will be cancelled.
• When paying by bank transfer, ak24parts.com must be sent a confirmation of the bank transfer via email. Confirmation is required to confirm receipt and process the order.

  Delivery by regular courier service is generally 1-5 days in Europe and to other world countries. The exact delivery time depends on the product ordered, location of your country and courier choosed (Fedex and DHL are fast starting from 1 day).

  8. INTERNATIONAL SHIPMENTS AND IMPORT DUTIES

  As the importer of the goods, you are responsible for complying with the laws and regulations of the country to which you ordered the products. 
  
  If the Buyer refuses, for any reason, to complete customs clearance or to collect the ordered goods from customs, the Buyer is obliged to return the goods to the Seller via the local postal service of the Buyer’s country or via DHL, and the Buyer shall bear all return shipping costs.

  • 9. WARRANTY
  •  
  All goods sold in the e-shop are subject to a guarantee subject to the laws of the EU. If the product has a different (longer) warranty period than the one provided by law, this is indicated separately in the product description.
  In the case of a warranty case, an expert's fee must be paid for diagnostics (fault detection) performed on the goods if the Seller is not responsible for eliminating the defect in the goods and repairing the goods is not possible. The Buyer must also pay the diagnostic fee if the goods are not found to be defective as a result of diagnostics (error detection) and the goods meet the manufacturer's technical requirements. The amount of the expert's fee may be different and depends on the price list of the supplier of the goods. 
  The Warranty  page is an integral part of these terms and conditions, and by accepting these terms and conditions, you also accept the Warranty terms stated    on the Warranty page.

  We recommend registering as a user of our e-shop. By logging into the e-shop, the registered user can view the current status of his order (whether the money paid for the order has also been received by us, whether the goods have been assembled or already shipped, etc.).

Third parties can be, for example, cooperation partners, whose tasks are the delivery of e-shop goods or the offer of installment payments. 
  •  Personal data is stored only as long as it is necessary to store it to fulfill the purpose of data collection in accordance with this Privacy Policy. Autokaubad24 OÜ may retain data longer than it is necessary to fulfill the requirements arising from the law or to protect the legal interests of Autokaubad24 OÜ.
  •  Autokaubad24 OÜ stores customer data for a maximum of 3 years from the customer's last order or from the moment the customer made a purchase. Autokaubad24 OÜ stores data that Autokaubad24 OÜ is required to store due to legislation (e.g. accounting data) based on the requirements stipulated in legislation.

In the case of an unregistered purchase, the Customer is obliged to disclose the following personal data to Autokaubad24 OÜ: first and last name, phone number, address, e-mail address and delivery address.
  •  Customers who wish to register on the Autokaubad24 OÜ page must provide the following personal data: first and last name, gender, e-mail address and set a password. By registering, the customer creates an account.
  •  The customer has the right to change and/or supplement personal data in his account at any time. The customer is responsible for the correctness of updated and changed personal data. The customer also has the right to delete his account. To delete the account, you must contact us by e-mail at [email protected]
  •  The customer's personal identification code is required only if the customer buys goods by installments. In addition, also when purchasing additional services where the customer's personal code is required (for example, to insure the goods in the case of goods with a warranty). When purchasing by installments, other personal data are also required, such as workplace, profession, etc.

• 11 FINAL PROVISIONS

11.1 These Terms and Conditions have been drawn up in accordance with the legislation of the Republic of Estonia.
11.2 The law of the Republic of Estonia shall apply to relations arising under the Terms and Conditions.

• 11.3 All disagreements related to the fulfillment of the Terms and Conditions shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedures provided for in the legislation of the Republic of Estonia and, if necessary, in Estonia. The parties hereby expressly agree and consent that the courts of the Republic of Estonia shall have exclusive jurisdiction to resolve disputes arising from these Terms and Conditions of Sale.
